1. Who we are

Axity AI ("Axity", "we", "us", "our") is operated by Lechwenyo Family Group. By creating an account or using the service, you ("you", "user") agree to these Terms. If you do not agree, do not use the service.

2. The service

Axity provides AI-powered chat, image generation, music generation, and related features accessed through our website and apps. Plans (Free, Creator, Studio) and their features are described on our pricing page.

3. Account & eligibility

You must be at least 13 years old, or the minimum age in your country, to use Axity. You are responsible for keeping your credentials confidential and for activity under your account. You must provide accurate information and keep it up to date.

4. Acceptable use

You agree not to misuse the service. Specifically, you will not:

• Use Axity for unlawful, fraudulent, or harmful purposes;
• Send spam, malware, or content infringing the rights of others;
• Attempt to break, probe, scrape, or interfere with the service or its security;
• Generate content that is illegal, sexually explicit involving minors, incites violence, promotes self-harm, or constitutes hate speech;
• Create deepfakes or impersonate real people in a deceptive way;
• Use AI outputs to provide regulated professional advice (medical, legal, financial, etc.) without appropriate human oversight;
• Attempt to reverse-engineer the service, circumvent technical limits, or resell access.

5. Your inputs and AI outputs

You retain rights to the prompts and content you submit. You grant us a limited license to host and process them solely to provide the service. You are responsible for the prompts you submit, the outputs you choose to use, verifying their accuracy, and for having the necessary rights to any input content.

AI outputs may be inaccurate, incomplete, or biased. They are not a substitute for professional advice. We may filter, refuse, or remove content, and may suspend accounts, for repeated or serious violations of these Terms.

6. Intellectual property

Axity, its software, branding, and documentation are owned by Lechwenyo Family Group and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the service within the plan you have selected.

7. Payments, billing, taxes & subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, subscription renewal, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms. See our Refund Policy for our refund window. Subscriptions renew automatically at the chosen interval (monthly or yearly) until canceled.

8. Suspension & termination

We may suspend or terminate your access for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the service at any time. On termination, your right to use the service ends; we may delete your data after a reasonable retention period (see our Privacy Notice).

9. Warranties & liability

The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties (merchantability, fitness for a particular purpose, non-infringement) and do not guarantee uninterrupted or error-free performance.

To the fullest extent permitted by law, our aggregate liability for any claim arising from or relating to the service is capped at the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages (including loss of profits, data, or goodwill). Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence where such limitation is not permitted by law.

10. Indemnity

You will indemnify and hold harmless Lechwenyo Family Group from claims arising out of your content, your unlawful use of the service, or your breach of these Terms.

11. Changes

We may update these Terms from time to time. Material changes will be communicated via the service or by email. Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the jurisdiction where Lechwenyo Family Group is established, without regard to its conflict of laws rules. Disputes will be resolved in the competent courts of that jurisdiction, except where mandatory consumer protection laws give you a different right.
